Export and save copies locally, often.
MECH Canvas is actively and continually updated. Updates, defects, maintenance, storage failures, account changes, or human error may unintentionally alter, corrupt, or permanently remove saved projects, uploaded files, settings, or other data. Do not treat the Service as your only copy or permanent archive.
1. Agreement and eligibility
This Beta Use and Data-Risk Agreement ("Agreement") is between you and Clayton Plymill, the operator of MECH Canvas ("MECH Canvas," "we," or "us"). By checking the agreement box and selecting Agree and continue, you confirm that you have read and agree to this Agreement. You must be at least 16 and able to enter this Agreement. If you use the Service for an employer or organization, you confirm that you are authorized to accept this Agreement for that use.
2. Beta service and changes
The Service is evolving software provided for graphics and floorplan creation. Features, formats, interfaces, storage behavior, limits, and availability may change at any time. We may add, modify, suspend, or remove features or data when reasonably necessary to operate, secure, repair, or improve the Service. We do not promise uninterrupted availability, backward compatibility, or a particular service level.
3. Your backup responsibility
- Export after meaningful work and save local copies frequently. Also export before relying on a project, closing a long editing session, or expecting a significant Service update.
- Keep important copies somewhere outside MECH Canvas. For especially important work, keep more than one copy on separate storage or in a storage service you control.
- Open or test important exported files promptly to confirm they are complete and usable.
- Operational server backups are maintained for service recovery, but they are not a user archive, are retained only temporarily, and do not guarantee that any individual project or version can be restored.
You accept the risk that projects, uploads, preferences, exports, or other data may be lost, changed, corrupted, or unavailable, including unintentionally. Contact us promptly if you notice a problem, but recovery may not be possible.
4. Verify outputs; no safety-critical reliance
MECH Canvas is a design aid, not engineering, architectural, commissioning, code-compliance, life-safety, cybersecurity, or professional advice. It is not a building-control runtime and must not be used to directly control equipment or safety systems. You are responsible for independently reviewing dimensions, labels, sequences, point mappings, animations, graphics, files, and other outputs before using them in a BMS, construction document, operational workflow, or customer deliverable. Use qualified professionals and the controlling project documents where appropriate.
5. Your content
You retain ownership of content you create or upload. You grant us a limited, non-exclusive license to host, copy, process, transmit, back up, and display that content only as needed to provide, secure, maintain, and improve the Service. You confirm that you have the rights and permissions needed for anything you upload and that your content and use comply with law and applicable agreements. Do not upload regulated, highly sensitive, export-controlled, or confidential information unless you are authorized and the Service is appropriate for it.
6. Accounts and security
Keep your credentials secure, use accurate account information, and promptly report suspected unauthorized access. You are responsible for activity under your account to the extent permitted by law. Organization administrators may assign or remove access. We may restrict an account to protect users, the Service, or others.
7. Acceptable use
You may not misuse the Service. Prohibited conduct includes unlawful or harmful activity; unauthorized access or security testing; bypassing access, usage, or technical controls; introducing malware; interfering with availability; impersonation; abusive automated requests; scraping, harvesting, copying, or training on Service content without written permission; reverse engineering except where law expressly permits it; or using the Service to violate another person's privacy or intellectual-property rights.
8. Our materials
The Service software, interface, branding, documentation, and materials supplied by us are owned by us or our licensors. Except for the limited right to use the Service under this Agreement, no rights are transferred to you. Feedback may be used without restriction or payment, but we will not identify you publicly as its source without permission.
9. Third-party systems and compatibility
The Service may interact with browsers, identity systems, email providers, file formats, BMS platforms, libraries, or other third-party products we do not control. Their changes, availability, terms, and security may affect the Service. You are responsible for confirming compatibility and complying with applicable third-party terms.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," with all faults and without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, data preservation, compatibility, or error-free operation. Nothing in this Agreement excludes warranties or consumer rights that cannot lawfully be excluded.
11. Limitation of liability
To the fullest extent permitted by law, Clayton Plymill and MECH Canvas will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, business interruption, replacement work, loss or corruption of data, or inability to use the Service. Aggregate liability arising from the Service will not exceed the greater of US $100 or the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited, including any liability that applicable law does not permit us to exclude.
12. Suspension, termination, and survival
You may stop using the Service at any time. We may suspend or terminate access for a material breach, security risk, unlawful activity, prolonged inactivity, discontinuation, or other legitimate operational reason. Export anything you need before ending use whenever possible. Provisions concerning ownership, disclaimers, liability, and records of agreement survive termination as applicable.
13. Privacy, law, and changes
The Privacy Notice explains how personal information is handled. Tennessee law governs this Agreement, without regard to conflict-of-law rules, except where the mandatory law of your location applies. Courts with jurisdiction in Davidson County, Tennessee, will be the agreed venue where that choice is legally permitted.
We may update this Agreement as the Service or law changes. The version and effective date identify the terms you accepted. We will require a new agreement before protected use when the Agreement changes. Contact admin@mechcanvas.com with questions.
